Terms of Service

1. Acceptance of Terms

By accessing or using the Binexia platform, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These terms apply to all users, including free trial and paid subscribers.

2. Description of Service

Binexia is a business intelligence platform that provides natural language querying, data analysis, document extraction, and proactive intelligence capabilities. The service is provided by Fimula. We reserve the right to modify or discontinue any feature with reasonable notice.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate information during registration and notify us immediately of any unauthorized access. Each user is responsible for all activity under their account.

4. Acceptable Use

You agree not to use Binexia for unlawful purposes, attempt to gain unauthorized access to systems, interfere with service integrity, reverse engineer the platform, or use automated tools to scrape data. We reserve the right to suspend accounts that violate these terms.

5. Data and Intellectual Property

You retain ownership of all data you upload to the platform. We do not claim rights to your data. The Binexia platform, including its software, design, and branding, is the intellectual property of Fimula and is protected by applicable law.

6. Payment and Billing

Paid subscriptions are billed in advance on a monthly or annual basis. Prices may change with 30 days written notice. Refunds are not provided for partial months. You may cancel your subscription at any time; service continues until the end of the current billing period.

7. Service Level

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance is communicated in advance. We are not liable for downtime caused by factors beyond our control, including force majeure events or third-party service failures.

8. Limitation of Liability

To the maximum extent permitted by law, Fimula shall not be liable for any indirect, incidental, or consequential damages arising from the use of Binexia. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

9. Governing Law

These terms are governed by the laws of Slovenia. Any disputes shall be resolved in the courts of Slovenia. Both parties agree to attempt resolution through good-faith negotiation before initiating legal proceedings.
